Judge confiscates 12-year-old troublemaker’s Nintendo Wii

A judge has ordered a 12-year-old troublemaker to surrender his Nintendo Wii to the court in exchange for getting bail.

The boy has been charged with a range of offences from vandalism to assault and the judge said he was tempted to not grant him bail.

But Judge Marivin Garfinkle of Winnipeg decided to embark on a highly different punishment – he confiscated the Wii to ensure the boy kept to his bail conditions.

“He is pledging as a security, akin to a cash deposit, his Nintendo Wii,” Garfinkle said. “And if he doesn’t comply, he loses it.”

Prosecutor argued the boy was out of control and needed to be kept in custody after he used a rock-filled sock to smash school windows and attacked a fellow pupil.

He even breached court orders to not attend school.

It’s almost as if he’s taunting the school,” said Crown attorney Susan Baragar.

“While the youth is 12 years old, it is our submission he is clearly out of control and will not obey any rules your honour may lay down for him,” she told Garfinkle.

But his lawyer defended him, saying he was just fightened.

“I know it doesn’t look good,” Serena Puranen said. “I’ve never seen him enraged, I’ve never seen him upset. He’s a 12-year-old who is generally quite scared.”
